DECENNIAL REPORTS DEADLINE FOR PENNSYLVANIA ENTITIES IS DECEMBER 31, 2011
According to the Pennsylvania Department
of State, a decennial report is a report of an entity's continued
existence or use of certain marks. Decennial filings are made every
ten years during the years ending with the numeral "1" (e.g. 2001,
2011, 2021). The legislative intent for requiring these filings is
to identify business names or marks that are no longer in use so
that they may be reissued and placed back into the stream of
commerce.
A decennial report is
not required if the association has made any filing in
the Pennsylvania Department from January 1, 2002 through December
31, 2011, other than a decennial report, application for
registration of fictitious name, consent to appropriation of name,
name searches or name reservations.
Decennial report notices were mailed to all associations required
to file on December 15, 2010. Failure to receive notice does not
exempt an entity from the need to file the decennial report. The
Corporation Bureau has made available a searchable database
identifying all associations who are required to file the Decennial
Report based on the Corporation Bureau records. The deadline to
file is December 31, 2011.
