BRIAN T. MUST
Brian concentrates his litigation practice in the representation of clients in complex and commercial business litigation and business torts, such as breach of contract, breach of warranty, finder's fee agreements, corporate and successor liability cases, trade secret infringement cases, professional malpractice claims, covenants not to compete, claims of tortuous interference with contractual relations, directors and officers liability claims, shareholder derivative actions and wrongful discharge claims. 

Through his representation of clients in these matters, Brian has accumulated extensive trial experience in both state and federal courts in various jurisdictions throughout the country, as well as alternative dispute resolution forums including the American Arbitration Association. He draws upon this solid background when advising clients on the various phases of litigation as well as their rights and obligations in litigation matters.

In addition to handling the commercial litigation matters outlined above, Brian has also handled matters involving product liability and property damage suits.

Representative Matters
• Represented a manufacturer, in the U.S. District Court of Rhode Island, against
a distributor in a breach of  distribution agreement (affirmed, First Circuit Court
of Appeals).
• Represented minority members, in Pennsylvania state court, against majority
members of a Pennsylvania LLC in a breach of fiduciary duty case.
• Represented a cemetery association, in federal court, in an antitrust action
brought by the trade association representing the Monument Builders of
Pennsylvania. 
• Represented a hospital in arbitration proceedings brought against it by its
former general counsel for breach of contract. 
• Represented a broker, in federal court, in a breach of contract action against a
food products manufacturer.
• Represented members of a Pennsylvania partnership, in state court, against
other partners in an action to wind up affairs of the business.
• Represented a distributor in federal court, accused of misappropriating trade
secrets and breaching a distribution agreement.
• Represented a franchisor against a franchisee in an arbitration proceeding for
breach of franchise agreement.
• Represented a manufacturer, in federal court, against competitors in an antitrust
and business torts claim.
• Represented manufacturers of commercial roofing products, in various state
and federal courts, in breach of warranty and product liability cases.
• Represented product manufacturer in various state and federal court cases
involving claims of personal injury from allegedly defective product.
