Justin Tuskan is a Member of the firm’s Banking and Litigation practice groups.

Justin provides counsel to banks, credit unions, investors, and other lenders in a wide variety of loan workout, enforcement, and finance matters. He represents creditors in connection with mortgage foreclosures, receiverships, confessions of judgment, replevin actions, loan modifications and forbearances, and Chapter 7, 11, 12, and 13 bankruptcies. Justin also serves as counsel to financial institutions in defense of liability claims arising under loan agreements, the Uniform Commercial Code, and consumer protection statutes including the FDCPA and the Unfair Trade Practices and Consumer Protection Law.

In addition, Justin maintains an active commercial litigation practice, with a focus on real estate matters and contract disputes. Justin represents landlords in connection with lease enforcement actions, buyers and sellers in disputes under real estate purchase agreements, and brokers and their agents in defense of seller disclosure and related claims. Justin also works with business clients to cost-effectively maximize recovery when not paid for products or services.

Justin serves on the Firm’s Recruiting Committee. While in law school, Justin was a judicial extern to the Honorable Terrence F. McVerry, United States District Court for the Western District of Pennsylvania. A nearly life-long resident of Western Pennsylvania, Justin, his wife Caitlin, and their daughter currently live in the Eastern Suburbs of Pittsburgh. In his spare time, Justin enjoys cooking, golf, and supporting his daughter’s competitive dance team.

Representative Matters

  • On behalf of primary secured creditor, successfully tried objection to Chapter 7 discharge of commercial guarantors for failure to file accurate bankruptcy schedules.
  • Negotiated and documented forbearance and modification agreement for bank with respect to multi-million-dollar line of credit facility as a result of multiple events of default by borrower engineering and construction company.
  • Obtained summary judgment on behalf of secured creditor in bankruptcy proceedings for alleged failure to comply with the automatic stay and violation of the UTPCPL.
  • Represented national banking institution in contested mortgage foreclosure action that led to resolution of all claims, including alleged violations of the Truth in Lending Act.
  • Negotiated advantageous resolutions of numerous claims against tenants on behalf of regional real estate development and property management firms.
  • Successfully sought early dismissal of all claims against national real estate brokerage firm and its agent for alleged failure to disclose defects in property’s plumbing system.
  • Awarded summary judgment in favor of equipment finance institution and against individual guarantors of $10 million lease obligation for digital signage in New York.
