We counsel clients on the acquisition, protection, exploitation and enforcement of intellectual property rights. We also support clients’ commercial relationships and disputes involving technological assets and data.
We obtain, maintain, enforce and help our clients strategically leverage their patents, trademarks, trade secrets and copyrights, both in the United States and abroad, with an eye toward each client’s unique business goals and objectives. We assist in the negotiation, creation and documention of commercial transactions relating to intellectual property assets, including licenses, assignments, non-disclosure, confidentiality, joint venture, joint development and distribution agreements. We work closely with each client’s legal team, both within the firm and other counselors, in corporate mergers, acquisitions and financing where intellectual property, technological and data assets are involved. We also provide counseling with regard to employment and HR policies relating to IP and proprietary information.
Our group litigates intellectual property, computer and other technology-related disputes in federal and state courts, in administrative proceedings before the United States Patent and Trademark Office, the United States International Trade Commission, and other public and private alternative dispute resolution tribunals including mediation and arbitration.
The members of our group are experienced in a wide variety of technical and industrial areas, including medical devices, fintech, materials sciences, manufacturing, metallurgy, oil and gas, biotechnology, health and information systems.
Data & Technology
We have leveraged our technical expertise and familiarity with technology and information systems to provide counsel to clients on transactions involving technological assets, information systems and data, including software and hardware licensing, development, purchase and sale. We work with clients to develop policies and procedures for protection of data, devices and systems, together with disaster recovery and post-breach remediation that are tailored for each client’s needs. We also advise on contractual obligations and indemnities to ensure responsibility for data usage, storage and breach are properly apportioned between the parties.
We work with our clients to address compliance issues and develop policies and procedures for data security and data privacy, both in accordance with the GDPR in Europe and under United States laws. This includes cooperation with and direction of outside forensic partners, insurance carriers and IT teams.
