Attention – Are your independent contractors really your employees?  The Department of Labor (DOL) is proposing an information system to collect worker’s knowledge of basic employment laws.  This system is being proposed to improve the DOL’s understanding of worker experiences with employee misclassification (ie. whether a worker is an employee or an independent contractor).  The DOL hopes to clamp down on employers which have misclassified workers in the hopes of raising millions of dollars of revenue (the DOL has estimated that if only one percent of workers were classified as employees and not independent contractors, the increase in unemployment compensation taxes alone would be $220,000,000).  Should you have any questions as to whether you, as an employer, have properly classified workers, please contact John B. Bechtol at 412.918.1115.
